Nope has to be part of the fillet the whole law was built to keep people from cutting fillets into pcs so you couldn't tell how many they had. If you could use the cheek skin they would just leave out a few cheeks and keep a couple extra fillets. I think it is a dumb law but laws are laws I guess.

I agree with the law being silly as it makes for a very messy, slimy situation when you peel the skin off at a later time but again it is the law. My question is why can't the filet just be left whole??? I think it would be pretty easy to identify whole, even without the skin.
